The Morris’ Rules of Stay @ Coloma Camperland

Introduction

 We (Mark and Liane) are the registered tenants and therefore referred to as such in all Rules set forth below.  We ask that while you stay in our camper you follow the rules and regulations, tenant lease agreement as well as our own rules of stay.  Not following these rules will result in not only the loss of your guest privileges but in a case that your actions have caused the eviction or termination of the tenants (us) lease. The tenants have the right to a) charge you for costs endured during your stay b) charge you for loss of lease term and transportation costs of moving to a new location and any said charges related to the result of having to move.


If you are unable or unwilling to abide by any of the following Rules and Regulations, Tenant Lease agreement or the Morris’ Rules of Stay that we ask that you please not request to stay with us or leave now if you have already arrived.

General Rules

  •  Guests MUST abide by Coloma Camperland Rules and Regulations as well as the Tenant Signed Lease agreement
  • Guests MUST abide by Tenants Rules of stay posted in the binder or on this webpage.
  • If Tenants are not onsite with Guests, guests will assume the responsibility for the tenant and must mow the lawn and weed the campsite per the Campground  site lease
  • If Tenants are not onsite with Guests, Guests will pay their portion of the Utilities during their stay.
  • Camper will remain locked when there is no one in constant eye site of the camper.
  • Keys will be returned to where they are retrieved from immediately at the end of the guest stay.
  • Keys are NOT to be copied at any time.
  • Any Damages caused by Guests will be paid for by Guests immediately.
  • If you use the last of something up, you replace it.  (ie. Paper towel. toilet paper, laundry detergent etc.) 

Camper Rules

  • Clean up after yourselves
  • Have FUN!

Kitchen Guidelines

Due to Liane having Celiac Disease there are strictly labeled items that are used for gluten containing items. 


All other utensils, dishes, cast iron etc. must be gluten free.  If you have any questions ask or bring your own kitchen items.

Bedroom/ Sleeping

  • NO Pets allowed in Master Bedroom or on couch/chairs or beds (with exception to hypoallergenic pets like Bristol)
  • Sheets and Pillowcases will be washed/Dried at YOUR expense in the laundry room between the bathrooms/showers of the main building.  When they are cleaned you will fold them and put them where you found them.

Pets

  • PETS ARE WELCOMED, but on a leash and cleaned up after.  
  • Pets are NOT allowed in Master bedroom.
  • If your pet sheds, be sure to vacuum extensively; as some of our guests are allergic.

General

  • Quiet Hours: From 11:00pm to 8:00am
  • Fires shall be confined to the fire-rings provided.
  • Bicycles: For Safety, please no bike riding in the park after dark without lights.
  • SPEED LIMIT in the park is 5 MPH.
  • All trash and garbage must be in tied plastic bags and put in the garbage area
  • Containers for recycled items will be furnished: (Glass, plastic, and tin-paper and cardboard – aluminum cans)
  • No cutting or damaging of any trees without the owner’s permission.
  • Registered campers are responsible for the conduct and behavior of their guests and children at all times.
  • All guests must register – and "may" be charged $5.00 per day at the discretion of the campground.
  • We reserve the right to deny access for visitation or camping.
  • At NO time will the use of alcohol by miners be permitted.
  • NO Fireworks will be permitted in the campground without a permit from the campground.
  • Camping is an outdoor experience. Therefore, we do not give refunds due to discomforts of nature.
  • CAMPING IS FUN; please respect the rights of others.


Pool

  • WARNING: there is NO LIFEGUARD on duty. Children under 12 years of age MUST be accompanied by an adult.  Over 12 MUST KNOW HOW TO SWIM or be accompanied by an adult.


Playground

  • An adult in the playground area must accompany children 12 years of age and under.


Pets

  • PETS ARE WELCOMED, but on a leash and cleaned up after.  Pets are not allowed in the pool area or the playground.
  • No pets are allowed in the Bar or Game Room.

Seasonal Agreement

 This seasonal campsite agreement is herein agreed to by Coloma Camperland & Rough Cut Saloon, LLC, hereafter referred to as “Coloma Camperland" or "Campground" and the party(ies) signing this contract, hereafter referred to as "Camper(s)". By signing this contract, the Camper(s) agrees to all of the terms and conditions of this contract as follows and further agrees to be bound by all rules of Coloma Camperland and assumes responsibility for adherence to these rules by family members and guests: 

Not A Lease. This Agreement is a contract which is binding on both the Campground and the Camper. This Agreement is not a lease of real estate. The Camper is not a tenant. This Agreement is, for legal purposes, a license to use the property of the Campground on the conditions which are stated in this Agreement.  


Camping season. The 2018-2019 camping season begins at 8:00 AM on January 1, 2019 and runs through 5:00 PM on December 31st, 2019.  The camper will have access to his.her site during the duration of that time. 


Seasonal Rate, The Camper agrees to pay the Campground the amount of ####.## in advance as payment for access to the site. Payment must be received by October 3rd, 2018.  The Seasonal Rate is no refundable and covers the Camper, Camper's spouse partner, and their dependent children. The Camper agrees to use the site for camping purposes only. The site may not be used as the Camper's primary residence. The Camper agrees not to sublet the site without prior permission from the Campground in writing. Permission is not guaranteed and may be withheld for any reason. The Camper agrees not to move to another site within Coloma Camperland without permission from the Campground in writing. Permission is not guaranteed and may be withheld for any reason. 


Site Renewal.  Prior to the expiration of the 20## camping season, the Campground may offer the Camper a 20## Seasonal Site Agreement with the option to reserve the same site for the following camping season at terms deemed suitable by the Campground. If accepted, the Camper may leave the camping unit on the site during the oft season: The Camper may access the camping unit during the off season as weather permits; but acknowledges that there will be no access to utilities during that time. If the Camper declines the option or fails to accept by the applicable deadline, the Camper agrees to remove the camping unit and all personal property belonging to the Camper from the campsite within seven (7) days after the expiration of this agreement. If the Camper fails to comply, the Campground will remove any and all items at the Camper's expense. 

 

Coloma Camperland is designed to be a family campground. If a Camper's behavior violates the spirit of the campground. Coloma Campground may determine that it is in its best interest not to offer a renewal. In this event, the Camper agrees to remove the camping unit and all personal property belonging to the Camper from the campsite within seven (7) days after the expiration of this agreement. If the Camper fails to comply; the Campground will remove any and all items at the Camper's expense.


Sale of Camping Unit and/or assignment of Rights.  The Camper agrees that all sales of camping units, which are anticipated or contemplated to be sold to a successor camper and remain on the campsite, are subject to the approval of the Campground. The Campground pay withhold approval of a sale for any reason, including the condition of the camping unit. The Camper agrees to pay the Campground a fee at closing of either 7% of the total sale price or $500, whichever is greater. Closing of an unapproved sale or the failure to pay the closing fee shall be considered a breach of this agreement. 


 The Camper shall not assign his/her rights under this Agreement at any time without written approval and authorization from Coloma Camperland. Approval may be withheld for any reason. Unapproved and unauthorized assignment shall be considered a breach of this Agreement. 


Abandonment. Removal of the camping unit and/or taking an action such as stating an intention to abandon the campsite to the Campground or other campers shall constitute an abandonment of the campsite. In the event of abandonment, Coloma Camperland will not refund or prorate the seasonal camping fee. By executing this agreement. Camper specifically affirms and stipulates that Coloma Camperland may act as Camper's attorney-in-fact for disposition and/or disposal of Camper`s abandoned property, including a trailer and/or mobile home. Coloma Camperland is authorized to take any reasonable action, including but not limited to, execution of documents of title as necessary for sale, transfer or disposal of Campers abandoned property. Coloma Camperland is specifically authorized to sign documents of title to any abandoned property, including vehicles, mobile homes, and/or trailers. In the event Camper fails to remove or repossess the camping unit and/or personal property within the prescribed time limits after termination of the agreement, Coloma Camperland may dispatch a notice to Camper personally or by regular U.S. Mail of its intent to dispose of the camping unit and/or personal property within thirty (30) days after the date of personal service or date of mailing of the notice, Coloma Camperland may dispose of the camping unit and/or personal property by private or public sale or any other appropriate means Coloma Camperland may deduct from the proceeds of sale any fees.or costs owed under the terms of the Agreement together with the costs of selling or disposing of the camping unit and/or personal property. Any excess proceeds shall be mailed by Coloma Camperland to the Camper's last known address.


 Rules and Regulations. The Camper acknowledges receiving a copy of the Rules and Regulations which are attached to this Agreement; incorporated by reference and made a part hereof. The Camper agrees to read and comply with the Rules and Regulations. Additional copies will be posted in the office and/or on the premises. Coloma Camperland may reasonably revise the Rules and Regulations, and, upon doing so, Coloma Camperland shall deliver, either personally or via U.S. mail, a copy  of the Revised Rules and Regulations to the camper. 

 

 Any Camper, their guest, or visitor who is in violation of this Agreement or in violation of the Campground Rules and Regulations is informed that this is cause for immediate termination of this Agreement. In the event that this agreement is breached, all potential refunds are at the discretion of the Campground. Upon termination of this agreement, the Camper will have seven (7) days to remove their unit from the site at their own expense. Any unit remaining following that seven (7) day period may be removed by the Campground at the expense of the camper. 


 Guests: For Campground safety: ALL Guests must register at the Bar by signing a Guest Registration Sheet 


Utilities. The camper agrees to pay all utilities. Additionally, the Camper agrees to pay a $3.00 monthly meter reading charge for electrical service. 


Golf Carts. Golf carts must be operated by individuals possessing a valid driver's license. The first instance of noncompliance will result in a warning. A second instance of noncompliance will result in the loss of privilege and will require the Camper to remove the golf cart from the campground premises. Further noncompliance will result  in the termination  of this agreement. 


 Animals. Pets must be leashed at all times and not left unattended at the campsite. The Camper agrees to clean up after his/her pets. Failure to do so will result in a $15.00 fine. Subsequent incidents will result in increased fines and/or the loss of pet privileges. Repeated failure to follow the Campground Rules and Regulations regarding pets may result in the termination of this Agreement. Because of insurance, certain dog breeds are not allowed on the premises. Campers will notify the Campground of their dog's breed and agree to adhere to the Campground rules. 

 

Mail. Any mail addressed to the Camper delivered to the Campground will be returned to sender, If the Camper desires to receive mail, he/she will secure a P:O. Box at the local post office. Coloma Camperland has based this decision of its inability to handle bulk mail for all of its campers in the past, The Campground asks for your cooperation and understanding.

 

Insurance. The Camper agrees to maintain his/her public liability, and fire, wind and other hazard insurances upon the camping unit and his/her personal  property (Including vehicles and gold carts) situated upon the campsite and for their acts or omissions occurring while occupying the campsite. The Camper will provide the Campground with proof of insurance.


Campground Unit and Site Maintenance.  The Camper agrees to keep his/her camping unit in a  clean and pleasing appearance. Roofs, siding, and windows shall be properly maintained, and, in the event damage occurs, shall be promptly repaired in a workmanlike manner. The Camper agrees to take care of his/her site. This includes mowing the grass and keeping the site clean and free of garbage. If the Campground has to cut your grass or otherwise take care of your site, there will be a $25.00 charge to the camper on the first instance. The cost will increase by $10 each time the Campground has to take care of your campsite. Repeated failure to take care of your campsite will result in termination of this agreement.


Late Fee. A $20 lale lee shall be issued for any unpaid amount owed to the Campground and at the end of each month until paid in full  


Serviceability. This agreement is sever-able. The invalidity or unenforceability of any provision of this Agreement shall not affect or impair any other provision, and such invalid or unenforceable provision shall be serviceable from remaining provisions which shall continue in full force and effect.

  

Governing Law. This seasonal site  agreement shall be governed by, constructed and enforced in accordance with the laws of the State of Wisconsin. 


Binding Effect. This Agreement shall be binding on all persons using the Camper's campsite. 


Release of Claims and Indemnity. In consideration of the mutual promises contained herein and other good and valuable consideration, Camper and Camper's spouse/partner, if applicable, on his/her behalf and on behalf of his/her minor children, if applicable for themselves, his/her heirs, legal representatives and assigns, release and forever discharge Coloma Camperland, its successors and assigns of and from any and all causes of action, claims, demands, costs, loss of services, expenses, compensation, and all consequential damages, on account of, or in any way growing out of, any and all known and unknown personal injuries, death, and property damage resulting from his/her entry upon and occupation of the Campsite and entry upon or use of Coloma Camperland's facilities Camper shall indemnify Coloma Camperland and hold Coloma Camperland harmless from and against any and all claims, actions, damages, liabilities, expenses, including attorney's fees, in connection with any occupant, invited or guest in, upon, or at Coloma Camperland and/or the seasonal site or any part thereof, due wholly or in part to any omission of Camper, Camper's invitees and/or guests, including, without limitation, any accident, injury or damage due to any person or property, or by reason of Carper's breach or default in the performance of Camper's obligations under this Agreement.  

If Coloma Camperland, it owners, agents and/or employees shall be made a party to any litigation commenced by or against the Camper, the Camper shall protect and hold Coloma Camperland, its owners, agents and/or employees harmless, and pay all costs, expenses, and attorney's fees incurred or paid by Coloma Camperland, its owners, agents and/or employees in connection with such litigation: Camper's indemnification under this Section shall survive the expiration or termination of this Agreement. Camper expressly waives any claims against Coloma Camperland, its owners, agents and/or employees to the extent that any damages are covered by any applicable policy of insurance which provides coverage to camper, including but not limited to subrogation claims arising from any insurance payments made by or on behalf of campers insurance. 


Entire Agreement.  The parties agree that the Agreement and any documents incorporated by reference constitute the entire agreement between parties. Any amendments or modifications must be in the form of a written document which must be signed and dated by the parties.  By signing this agreement I/We am/are hereby acknowledging that all campers, occupants and family members, guests and invitees have read and understand the campground rules, as well as this agreement, and that all such individuals agree to be bound by and comply with the terms of this agreement and campground rules and regulations.
